Terms of Sale

1. Who you are buying from

Kali.J Design, operating as The Toy Showroom, 1302 Monte Vista Ave, Suite 21, Upland, CA 91786. Email [email protected], phone (909) 870-7095. The showroom is open to shop Tuesday through Saturday, 2:00–6:00 PM Pacific; we are a small operation, so please call or text ahead if you are travelling. Selling to us, consignment drop-off and estate buyouts are by appointment.

We are the seller of record on every order placed here — including items we sell on behalf of consignors. Your contract is with us, not with the consignor, and you deal only with us for questions, returns and refunds.

2. Everything here is pre-owned

We sell pre-owned collectibles and apparel on the secondary market: vintage toys, die-cast, Funko, action figures, comics, trading cards, clothing and shoes. Our stock comes from private collections, estate purchases and consignment from individual consignors.

“New” still means pre-owned here

Some items are listed in New condition — new with tags, unopened, or factory sealed. That describes the condition of the item. It does not mean it is new retail stock. We are not a brand, not an authorized dealer, and not an authorized distributor for anything we sell. Every item we list, in every condition, was acquired by us on the secondary market.

We resell genuine goods that were already lawfully sold once. In the United States that right comes from the first sale doctrine — 17 U.S.C. § 109 for copyrighted works, and trademark exhaustion under U.S. case law, which permits the resale of genuine trademarked goods that have not been altered or misrepresented.

Brand and character names appear in our listings only to identify what the item is. We are not affiliated with, sponsored by, authorized by or endorsed by any manufacturer, studio or rights holder.

We do not grade items and we do not issue authenticity opinions. We photograph the actual item you will receive and describe it as accurately as we can. If authentication or a professional grade matters to you, buy accordingly and have it graded yourself.

3. One of a kind means exactly one

Most of our active items exist in a quantity of one. That same single item is usually also listed on eBay, and it can be bought in person in the showroom. So there is a real, unavoidable risk that two people reach for the same object at the same moment.

Here is what we actually do about it, rather than what would sound good:

If it happens anyway: we email you as soon as we know, and we refund you in full — item, shipping and tax — to your original payment method. That is the whole process. No store credit unless you ask for it, no restocking deduction, and no substituting a different item without asking you first. Refunds are issued as soon as we confirm the conflict, normally the same business day.

4. Prices, errors, and when your order is accepted

The price you pay is the price our server calculates at checkout from our live catalog — not a price shown on a cached page, a screenshot, or a stale browser tab. Prices are in U.S. dollars and can change at any time before you check out.

We list by hand and we make mistakes. If an item is listed at an obviously wrong price, described incorrectly, or is no longer available, we may cancel the order before it ships and refund you in full. We will not ship a mispriced item and then bill you the difference, and we will not quietly downgrade what you ordered.

Placing an order is an offer to buy. We accept it when we hand the parcel to the carrier, or when you collect it at the showroom. A payment confirmation or an order page is a receipt for money received, not our acceptance of the sale.

5. Best offers

Most items take offers. A real person reads every one, usually within a few hours. You will get an accept, a counter, or a decline.

6. Payment

Payments are processed by Stripe on Stripe's own secure page. We accept credit and debit cards, Stripe Link, and Apple Pay and Google Pay (both run over the card networks). We never see, handle, or store your card number — it does not touch our servers.

Your order is charged in full at checkout. We do not offer buy-now-pay-later or other delayed payment methods, deliberately: those settle late, which would leave you unsure whether your order went through. If your bank declines the card, nothing is charged and nothing is reserved.

Card charges from us usually appear as KALIJDESIG on your statement. Banks shorten these differently, so it may look slightly different on yours. If you see a charge you do not recognise, call us before you dispute it — we can find your order in about a minute and sort it out.

7. Sales tax

We are a single California storefront, so we charge California sales tax on California destinations only:

Tax is calculated on the goods. Actual postage is stated separately on your order and is not taxed in California. The exact tax appears as its own line before you pay — nothing is buried.

8. Delivery, title and risk of loss

Full details are in Shipping & Returns. The part that matters most:

The risk of loss or damage in transit stays with us until the parcel is delivered to you, not from the moment we hand it to the carrier. If it is lost or arrives damaged, we file the carrier claim — you do not. Title passes to you on delivery and full payment.

9. Condition, and what “collectible” means for safety

Photos show the actual item. We note the flaws we find, but these are used objects with age on them — expect honest wear consistent with the stated condition. If a specific detail matters to you, ask us before you buy and we will look at it and tell you straight.

Vintage and collectible items are sold as collectibles for adult collectors. Older toys were made under earlier standards and may not meet current safety, labelling or small-parts requirements. They are not intended as children's playthings and should not be given to young children.

Apart from the rights the law gives you and the return rights in our posted return policy, items are sold in the condition described.

10. Limitation of liability

To the extent the law allows, our total liability for any order is limited to the amount you actually paid for that order, and we are not liable for indirect or consequential losses — lost profits, lost resale value, or the collection you were assembling around the item.

This does not limit liability for fraud, willful injury, or anything else California law says cannot be limited, including California Civil Code § 1668. Nothing in these terms takes away a right that California or federal consumer law gives you.

11. Governing law and how we handle disputes

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any court action goes in the state or federal courts serving San Bernardino County, California.

Email us first. Nearly everything is a shipping problem or a description question, and we answer within two business days. Most disputes end with a refund and an apology on the same day we hear about them.

We do not force you into arbitration and we do not make you give up a class action. Your right to bring a small claims case is untouched.

If you are thinking about a chargeback, contact us first. We can usually refund you before your bank finishes opening the case.
